These Terms of Service ("Terms") govern your access to and use of the Five Star Local website located at fivestarlocal.co (the "Site") and any related services provided by Five Star Local ("we", "us", or "our"). By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, please do not use our Site.
You may use the Site for lawful purposes only. By using the Site, you agree that you will not:
The Site and its entire contents, features, and functionality — including but not limited to text, graphics, logos, and software — are owned by Five Star Local and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any portion of the Site without our prior written consent.
Our Site may reference or link to other websites and services, including other properties we own and operate (such as Rapid Feedback at rapidfeedback.net) as well as independent third-party services. Where a linked site is operated by a third party, that site is governed by its own terms of service and privacy policies, and Five Star Local is not responsible for its content, practices, or availability.
We also operate other websites and forms. Inquiries we receive there are treated like inquiries from this Site. We do not list every one of those websites here.
Links to other websites do not constitute an endorsement of those sites or their content.
Rapid Feedback is our product. Five Star Local is the public name for the same business. Rapid Feedback is a tool to help you ask customers for feedback after a job. It is not a promise that reviews, calls, or extra jobs will happen.
You type the customer's name and email. The message goes out from your own Gmail or Outlook. We do not send it from a Five Star Local inbox. We do not promise that every customer will open it, read it, or leave a review.
If you keep the product after the trial, the paid plan is $49 USD per month after a 90-day free trial that does not need a credit card. You can cancel anytime.
Your customer may be sent to a public Google review page. If they are not happy, you will receive their feedback so you can make it right. You are responsible for your own Google Business Profile and for following Google's terms.
If they do not reply, you can have the product send one reminder from your own email. That is optional.
Payment after the trial is handled by Stripe. We do not receive or keep your card number.
You are responsible for the customers you enter and for following the law when you email them, including Canada's anti-spam rules. We store their name and email so the tool can send the ask and show you the reply. Details are in our Privacy Policy.
Stories and numbers on the Site — including “one extra job more than pays for it,” more 5-star reviews, a phone that rings, customers leaving a review, and “more reviews = more business” — are examples to explain the idea. They are not guarantees. Results depend on the work you do and how you use the product.
Lines such as “people check Google before they call,” that you are losing business, or that the next customer picks the shop with more stars are general talk and opinion. They are not from a study we are citing.
THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FIVE STAR LOCAL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
That includes the examples and opinions described in section 5.
We do not warrant that:
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIVE STAR LOCAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claim arising out of or relating to these Terms or the Site shall not exceed $100 CAD.
The same limit applies to Rapid Feedback.
You agree to indemnify, defend, and hold harmless Five Star Local and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Site. This includes how you use Rapid Feedback and the emails you send to your customers.
When you submit a form on this Site, or on other websites and forms we operate, you consent to Five Star Local contacting you about your inquiry. If we email you about our product, you can ask us to stop.
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. That policy also covers Rapid Feedback, including information about your shop and the customers you enter.
We reserve the right to modify these Terms at any time at our sole discretion. We will indicate changes by updating the "Last updated" date at the top of this page. Your continued use of the Site after any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
We reserve the right to modify, suspend, or discontinue the Site (or any part thereof) at any time with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.
These Terms shall be governed by and construed in accordance with the laws of the Province of Prince Edward Island and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Prince Edward Island, Canada.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Five Star Local regarding your use of the Site and supersede all prior agreements, representations, or understandings.
